Software or any other ware for that matter is resalable. Just because you’ve bought something doesn’t mean its sold exclusively to you – what would people do if General Motors suddenly announced the used car market was illegal and once you’ve bought that lemon, it’s yours exclusively? General Motors is suddenly out of business.

Put it up for sale on ebay or whatever, as long as you purchased it and it is not pirated, you are free to sell it or give it away.

I’ll admit right up front I’m confused about what I can and cannot do
legally…
I have a copy of the Adobe Camera Raw Plugin software. I bought it from
Adobe
about 2 months ago, downloaded it, and used it with Photoshop 7.0.1…
BUT, I’m
now upgrading to Photoshop CS, which doesn’t need the plugin to convert
RAW and
I’m figuring I might as well sell the CD I burned with the plugin on it…
Since I paid the *&^%$ at Adobe their $100+ for the thing is there any
reason I
CANNOT put it up for auction on Ebay or sell it on Nikonians or whatever?

Even though you paid for it, you cannot sell it on ebay since it is a burned disk. Only original CD’s are allowed on ebay.. CD’s which are not original are considered pirated by ebay legal..

Your best bet is to get Adobe to send you written documentation that you do in fact own that copy and sell to an individual. Keep the original doc and make a copy to go with the software..

Except that ebay does not allow burned CD’s to be sold on their auction site..Only original CD’s are allowed..

The license agreement says what you cannot do.

The problem is…
Adobe only sold you a license to use the software, not to re-sell it. You might still find someone to buy it because Adobe have stoped offering it now that CS is released. I’d give it a go on a dedicated digital forum… Stuff the bastards!

You can and should download Adobe’s License Transfer
Agreement/Authorization, which the buyer can then complete, mail in and have the license transferred to him/her.

Might be a good time to re-read your user agreement…

That’s a very good idea. The signed transfer is saleable on ebay.

Thanks for the info. I’ll try to find the transfer agreement at Adobe. I have no interest in doing this illegally. Its just not worth it for a $100 piece of software… It was me who was stupid enough to buy the thing instead of just upgrading at the time…

It was not stupid to buy the RAW conversion plugin. That way you could have avoided Product Activation. Which would have been very wise.

And are we then supposed to upgrade to a new Photoshop version every time there is a new camera with its own proprietary RAW format?
