The two processes that Photoshop Elements 3 starts,
PhotoshopElementsDeviceConnect.exe and PhotoshopElementsFileAgent.exe, continue to run after PSE3 exits. Are these Spyware?

I doubt it! Adobe doesn’t do that. But you can get TCPView from http://elearning.winona.edu/jjs/tmp.gif. It shows you the network addresses that any program opens. Even if it opens to Adobe.com it still does not mean it’s true spyware.
