Copyright on Actions in Photoshop

I work for a studio that uses an action set that was made by another studio. Since using it i have made chagnes to the action itself, quite a bit actually. The action only uses features available in Photoshop(contact sheet; Copy; Paste; Print; etc), no external programs are used. So if i have made changes to it is it legal for me to post my action for free, or could i even go about selling it through the studio I work for?

From a merely legal perspective, how could anyone prove that you didn’t make it from scratch?

I’m not a lawyer, nor do I even play one on TV, but I rather doubt that an action made with Photoshop *could* be copyright protected. After all, it’s not original code writing, nor does it apply to a specific image that has been created.
