I have been trying to find an answer like forever but I just can’t find it. I am a staff at a hospital owned by a university and I would like to know if I am eligible for educational version of photoshop and premiere pro. Thanks.

What I found on adobe website is:
< http://www.adobe.com/cfusion/knowledgebase/index.cfm?id=tn_1 9592#edu>

quote from that link:

How do I know if I am eligible to use the Education version of the software? What are the limits on my use if I acquire software with an education discount?

Adobe offers qualified educational institutions, organizations, and end users (such as administrators and students) the opportunity to buy Education versions of our products for administrative or educational instruction purposes only.

Educational institutions and organizations must meet one or more of the following criteria to qualify for the education discount and purchase Education Versions of our software:

* Accredited public or private universities, colleges, and community colleges that grant degrees requiring at least two years of full-time matriculation
* K-12 schools, school districts, administrative offices, and boards of education that purchase for the schools above
* Hospitals, libraries, labs, and museums wholly owned and operated by the schools above * Home schools approved by Macromedia at its sole discretion * Accredited vocational schools (i.e., trade schools providing certificates for specific specialties, such as Heald Business School)
* Training centers qualified to purchase the Macromedia K-12 Training Center Solution

As set forth in the EULA, Education versions cannot be used for any commercial purpose. A commercial purpose is any revenue-generating activity beyond an educational institution’s usual and customary educational activities.

Submit the order through the Educational department. You will receive instructions on submitting your credentials prior to Adobe processing the order. Thereafter you will be advised if you qualify.

That refers to the Macromedia products now offered under the Adobe name. The license for Photoshop CS3, as installed on my computer, does not include any restrictions on use of the Education version. The only provisions relating to the Education version are that (a) it may not be transferred; and (b) the purchaser needs to meet the eligibility criteria. The file I reviewed was D:\Program Files\Adobe\Adobe Photoshop CS3\Legal\en_US\license.html (and there are also no restrictions in the …\en_GB\license.html file).

Unfortunately, there does not seem to be any way to view the EULA for PsCS3 on Adobe’s site. You can find Photoshop CS and CS2, and you can find all of the former Macromedia products’ EULAs as well.

Is the university a teaching university. Then you _might_ qualify. If it is just a matter that the university owns the hospital, as you say, then I would guess not.

However, I, and others who will answer from here, will not be able to give you a definative answer. You will need to phone Adobe Customer Service for real facts. (And if you get shot down, ask to speak to the supervisor. Some CSRs seem to work on the basis of "if you don’t know the answer to that, make one up").

A hospital can purchase the Edu/Institutional version for it’s *own* use (ie: AV, Graphics, Photography departments). The employees are not eligible. Why would they be? Though if you are a student then you are. To benefit from the discount the order must be placed through the hospital’s Purchasing department. Are they going to start ordering software (or groceries) for their employees. I think not. 🙂

This university is definitely teaching and doing research. The hospital is part of the medical school of the university. I guess I will have to call them. But yes, I do feel like they don’t know what they are talking about. They did even know what they were talking about and they have this on website!

Yes, and you are ONLY an employee. You are NOT the hospital! The discount is offered for a qualifying institution to buy for their own **internal** use only. The sale has to be made to THEM and not YOU. That’s pretty clear isn’t it?

I do feel like they don’t know what they are talking about.

I think it’s *very* clear in the text you posted.

First off, that’s the old Macromedia EULA. The Adobe EULA allows for commercial use.

Are you a teacher or administrator? If so, you should qualify. If not, you don’t.
