hi, i have a small question, rather a big one concerning copyright of pictures found on the net and scanned. i know this has been posted before but my question is slightly different. my question is if i take a picture on the net (any pic, animal, human) or if i scan the pic of something found in a mag then modify it and the trace the pic using illustrator or any other trace program and then use the vector file, is this somewhat going against copyright laws. the thing here is that i am not using the original material that i found or scanned but rather uisng a vector file of it. so is this againt copyright.?

Yes. You are creating a "derivative work."

Yes.

Copyright forbids making any "derivative work" without the permission of the holder of copyright. A derivative work is any work that is based in any way on the original. Using part of it, modifying it to any extent, tracing it…all of these things are making "derivative works," and all are copyright infringement.

What the other people said, plus, it is not unknown for companies to sue if images are "misused". The one I always remember is a Corel lawsuit when someone used one of the images they provided for commercial purposes – Corel sued on their behalf and that of the artist and won. Whilst it’s unlikely to happen if the image isn’t widely seen (the fool used the image to enter a nationwide competition, which he won) it does happen.
