Have a folder full of pics that i want to "save for web", when i try to automate I get a message saying that an image with that name is already in the folder. I need to keep the file name. I cant get the files to be saved in a different folder.

Any ideas

save it as a different file name – move it into another folder and change the name back
or
change the name of the existing file and then do what you need to do and save your file as the name you want

Why can’t you get it to save in a different folder? You should be able to choose a destination folder in the Batch dialog. What exactly are you doing, step-by-step?

What version of Photoshop, platform, etc.?

Even though I choose a destination folder I find that the files are saved on the desktop. I wonder if it is something that I did wrong when recording the action?

When i recorded the action I had to record the save, unlike other recordings I did not save the file when I was making the recording – this seemed to work well.

Any ideas?

In the File->Automate->Batch dialog, did you put a check mark in the box for ‘Override Action "Save As" Commands’?

I have no problem doing this, but they do seem to have messed up the Batch command in 7. With a file open try double-clicking on the Export step in the actioon and specifying where you want it saved. Then run the Batch and also target the destination folder but check "Override…". Works fine here.
