Rubber Stamp Error in Photoshop CS PC Version

When I attempt to use the rubber stamp tool on the PC CS a prompt states that the command cannot be completed because of an error in the program. Has anybody run into this same problem, and what is the fix?

It seems to be a certain image that activates this prompt. It is originally a scanned image. When scanning an image into CS is there a certain mode that we have to stay with?
